TERM OF USE

LAVA SERVICE AGREEMENT

I. DEFINITIONS AND SERVICE DESCRIPTION:

  1. Agreement Terms:

LAVA invites you to use the online gaming services on web and mobile (hereinafter referred to as "Service") based on your acceptance of all terms and conditions stated in the LAVA Service Agreement (hereinafter referred to as "LSA"). To confirm your agreement, you must click the "Agree" button at the end of the account registration process, after reading and understanding the terms outlined in the LSA.

You need to read and agree to all the regulations in the LSA before using the Service to understand your rights and obligations when using the Service. By using the Service, you are deemed to have voluntarily agreed to all the provisions in the LSA.

The LSA constitutes the entire agreement between LAVA and the User. The LSA does not replace any additional terms that the User has been notified of by LAVA and applies when using content or services from third parties. LAVA reserves the right to amend this agreement at any time, and amendments will be effective after being announced on LAVA's official website. Users can review the LSA by periodically accessing the Service's website to see any modifications. If any amendments are not accepted by the User, they may terminate the LSA. Continuing to use the Service after amendments have been announced will be considered as acceptance of all such amendments.

  1. Definitions:

2.1. "Lava ID": An account used to access LAVA's gaming services and other products and services.

2.2. "Account Holder": The person who owns the Lava ID account.

2.3. "LAVA Online Gaming Service (hereinafter referred to as "Service")": Online game products on webgame or mobile game provided by LAVA. The Service includes game products provided on the homepage, and users can play online games on web, on PC, and download games to mobile phones.

2.4. "LAVA": The entity providing online gaming services. LAVA is the provider of online games and uses the Lava ID account for gaming.

2.5. "Lava ID": The unique code provided by LAVA for each player when using the Lava ID account to play games. Each account holder will be given one unique Lava ID throughout the gaming process.

2.6. "User": The person using LAVA's online gaming services, who owns the Lava ID.

II. REGISTRATION, LOGIN, AND ACCOUNT PROTECTION REGULATIONS

  1. Registration:

To use the service, you need to register a Lava ID by filling out the registration form available on the website (registration section) or accessing the game (registration section). To use the service, you need to complete the registration process, and creating an account means you agree to all terms of the agreement.

When you start using the gaming service, you will log in with your registered Lava ID. You need to create a character and choose a game server to identify yourself in the game. You are fully responsible for all activities performed through your account. You must comply with the naming rules for accounts, characters, guilds, etc., as follows:

  • You may not choose account names, character names, or guild names (if applicable) related to organizations, government, beliefs, or religions of the Socialist Republic of Vietnam.

  • You may not choose account names, character names, or guild names (if applicable) that violate the law, are subversive, violate public morals, or contain sensitive, vulgar, or defamatory content.

  • You may not choose account names, character names, or guild names (if applicable) that disrupt or undermine the reputation of LAVA's products and services.

  1. Login:
  • You will use your successfully registered Lava ID to log in to the game.

  • For a Lava ID account, the user will have one password to log in and access all services using the Lava ID.

  • You are responsible for protecting your account information and must immediately notify LAVA if you believe your account information has been compromised. LAVA is not responsible for account breaches due to leaked passwords and is not liable for complaints about accounts if the user cannot provide verification information as the account holder.

  1. Account Protection:
  • The Lava ID registration information includes email (or phone number) and password.

  • After successfully registering a Lava ID account, you should update your personal information for your account to protect it:

    • The user's email must be verified to protect the account.

    • Any other security information required.

The registration information used to protect the account will be used to verify account ownership. When complaints about the account arise, LAVA will assist when you provide complete and accurate registered information.

III. RIGHTS AND RESPONSIBILITIES

  1. Rights of the Lava ID Account Holder:
  • You have the right to change your login account and password, and update the registered account protection information.

  • You have the right to use the Lava ID account to access and use all services associated with the Lava ID account, including online gaming services provided by LAVA.

  1. Responsibilities of the Lava ID Account Holder:
  • Register account names according to the registration regulations as mentioned above.

  • Register complete and accurate personal information and protection details to prove ownership of the account.

  • Provide evidence proving you are the account holder when requested by LAVA.

  • You are responsible for protecting your account information, including the registered email for Lava ID and transaction information. You must immediately notify LAVA if you believe your account information has been compromised.

  1. Violations and Penalties:

When using the products and services, you agree not to engage in the following behaviors:

3.1. Relating to Misuse of Products and Services for Bad Purposes:

  • Opposing the Socialist Republic of Vietnam, insulting, harming national security, public order, religious or ethnic conflicts, inciting violence, or promoting war...

  • Promoting social vices and obscene content, violating public morals.

  • Defaming, falsifying, or insulting the reputation of organizations or individuals.

  • Advertising or promoting products and services other than LAVA’s, especially banned products and services.

3.2. Relating to Interference with LAVA's and Partners' Intellectual Property Rights:

  • Removing copyright and intellectual property information from products and services.

  • Copying, modifying, adding, or changing the features or functionality of products and services without LAVA's written permission.

  • Creating websites similar to LAVA’s intellectual property or exclusively authorized content.

3.3. Relating to Using Products and Services for Profit:

  • Unauthorized use of other players' accounts or passwords.

  • Buying, selling, or exchanging in-game items or currency with real money, cash, or physical goods.

  • Disrupting fairness by exploiting game bugs or using software or applications to interfere with the game; or any other actions to gain unfair advantage contrary to game regulations.

  • Soliciting, deceiving other players, or impersonating others in the game.

  • Other actions violating the law, public morals, and standard gaming community and online entertainment rules.

For violations of the above regulations, LAVA has full authority to address the violations according to the severity, through one or more of the following methods: (1) Warning or reprimand; (2) Deducting or retrieving in-game items or currency involved in the violation; (3) Temporarily or permanently suspending the account; (4) Other legal actions if there are signs of legal violations.

3.4. Refund and Cancellation Policy:

  • We accept order cancellations within 24 hours from the time of successful payment if the customer has not yet received the service (LVCOIN).
  • We DO NOT accept order cancellation requests in the following cases:

3.4.1. The customer requests to cancel the order after the LVcoin has been successfully credited.

3.4.2. The customer only notifies the cancellation via Fanpage and does not send an email with supporting documents requesting transaction cancellation.

3.4.3. The customer has used part or all of the LVCoin/in-game currency that has been topped up.

3.4.4. Complaints related to account issues such as account disputes (due to buying, selling, transferring, account sharing, etc.) or transactions with ongoing complaints or disputes (e.g., fraudulent cards, chargebacks) allow LAVA to lock the account until the dispute is resolved.

For complaints related to top-up transactions into the game (via Scratch Cards/Bank Cards/Paypal), LAVA will only process transactions that occurred within the same month and the complaint must be submitted before the last day of that month. Complaints regarding transactions outside of the specified timeframe will not be processed by LAVA.

  • LAVA is not responsible for compensating any damages incurred during the transaction complaint process.

 

  1. LAVA's Rights:
  • LAVA has the right to temporarily or permanently suspend a Lava ID account if it detects violations of the service agreement terms.

  • LAVA has the right to interrupt services occasionally for maintenance or without prior notice (due to unforeseen errors).

  • You agree that services may be interrupted due to reasons beyond LAVA's control, and LAVA cannot guarantee that you will be able to use the Service during such interruptions. LAVA is not responsible for any service interruptions, delays, or failures due to external factors like natural disasters, wars, network or electricity issues.

  • LAVA has the right to change, update, add, or remove parts of the LSA without prior notice. However, once changes are made, LAVA will notify customers using the service through announcements on the service’s homepage.

  1. LAVA's Responsibilities:
  • LAVA is responsible for protecting the information you provide except as outlined in the agreement or with your consent. LAVA will not provide your personal information to third parties without your consent. LAVA may provide information to law enforcement agencies for investigation if you or your account violates the law or in legal matters. If you request technical assistance, you agree to remote access and checking your computer for software needed to assist and fix issues.

  • LAVA is responsible for supporting customers in using their accounts during gaming.

  • LAVA is responsible for receiving and resolving complaints related to accounts and online gaming services within the stipulated time for handling issues as specified for each type of error.

IV. SERVICE AGREEMENT

  1. Your Consent:

By using the Lava ID account to log in to LAVA's online games, you confirm that you accept the contents of the LSA. If you do not agree with the LSA, please stop using the online gaming service.

  1. Links and LAVA Services:

LAVA is not responsible for any legal obligations (if any) arising from your use of third-party services or websites not provided by LAVA. Therefore, we recommend that you exercise caution when leaving LAVA services or websites and carefully read the general and specific regulations of each service or website you visit.

  1. Error and Transaction Dispute Handling:

3.1. Detecting Errors or Invalid Transactions:

When you perform a transaction to purchase gold or in-game currency, after each transaction, we add the service (LVCoin/in-game gold) into your account.

If you detect an error or invalid transaction during the transaction process or after payment is confirmed, please contact our customer support immediately.

3.2. Handling Transactions:

You must contact customer support through the contact information available on LAVA's official website within 30 minutes of noticing any errors or invalid transactions. After this period, the transaction is considered complete, and LAVA will not be responsible for any issues arising from the transaction.

V. OTHER TERMS AND CONDITIONS

  1. Privacy Policy:

Your privacy is very important to us. LAVA is committed to protecting your personal information in accordance with our privacy policy. Please refer to the privacy policy on our website for details on how we collect, use, and protect your information.

  1. Modifications and Termination:

LAVA reserves the right to modify or terminate the Service or any part of the Service at any time without prior notice. You agree that LAVA is not liable for any modifications, interruptions, or terminations of the Service.

  1. Governing Law and Dispute Resolution:

This Agreement is governed by the laws of the Socialist Republic of Vietnam. Any disputes arising from this Agreement shall be resolved through negotiation. If negotiations fail, disputes shall be submitted to the competent court in Vietnam.

  1. Severability:

If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

  1. Force Majeure:

LAVA shall not be held liable for any failure to perform its obligations under this Agreement due to events beyond its reasonable control, including but not limited to natural disasters, wars, strikes, or technical failures.
